The date is not the date that the transfer of the debtor’s money took place but the date the Writ of Garnishment was issued.

In a case, the Writ of Garnishment was 91 days before the debtor’s bankruptcy filing.   Because the petition was filed one day too late, the debtor lost an opportunity to recoup over $6,000 in garnished wages.

What is a Wage Garnishment?

  • It is a legal procedure in which a person’s earnings are required by court order to be withheld by an employer to pay a debt owed to a creditor.

What is your Employer Required to Do?

  • When an employer receives a wage garnishment order that was obtained by a creditor/attorney for the creditor, they are required to comply.
  • Within ten (10) days of receiving the garnishment order, your Employer must start withholding your wages (garnishing your wages) and remitting payment to the Sheriff’s Office/Court Officer.
  • Failure or refusal of your Employer to comply, could result in your employer being liable for your debt. (So, you know they will comply)
  • Your employer is powerless to stop the wage garnishments – it is beyond their control.
